The Service
OmniImage provides client-side and web-based image tools for convenience. Features may change, be suspended, or be discontinued. We do not guarantee uninterrupted or error-free operation.
Acceptable use
You agree not to misuse the Service, including attempting to disrupt, overload, scrape in a way that harms performance, violate others’ rights, or process unlawful content. You are solely responsible for your content and for ensuring you have rights to process and export images you upload.
No professional advice
The Service is not legal, medical, or professional advice. Output quality and suitability for any purpose are not guaranteed.
Intellectual property
The Service, branding, software, and documentation are protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, we reserve all rights. You retain ownership of your images as described in our Privacy Policy.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OMNIIMAGE AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), IF YOU HAVE NOT PAID US, THEN (B) ALONE APPLIES.
Indemnity
You will defend and indemnify us and our affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws applicable to the operator of this site, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive venue, unless mandatory consumer protections in your country require otherwise.
